TRAKFORCE OFF-ROAD TIRES products are engineered and manufactured exclusively for off-road applications. This disclaimer applies to all products sold through trakforce.us and any authorized TRAKFORCE dealer locations.

Product Restrictions

• These tires are NOT DOT (Department of Transportation) Approved for highway use
• NOT FOR HIGHWAY USE, PUBLIC ROADS, OR STREET DRIVING under any circumstances
• Intended applications include: rock crawling, mud terrain, trail riding, off-road competition, sand, and similar off-road environments exclusively
• Tire sidewall is permanently marked: "NOT FOR HIGHWAY SERVICE"
• Use of these products on public roads may violate federal, state, or local traffic laws and regulations
• Operation on public roads with non-DOT approved tires may result in fines, vehicle impoundment, or criminal liability
• Insurance coverage may be void if an accident occurs while using non-DOT approved tires on public roads

Applicable Models

This disclaimer specifically applies to, but is not limited to, the following TRAKFORCE product lines: SL808 Series, MUD GRIPPER Series, and any other model explicitly marked as "Off-Road Use Only" on the product page or tire sidewall. Always verify the intended use of any product before purchase by reviewing the product description or contacting our support team.

Transparency Commitment

TRAKFORCE OFF-ROAD TIRES is fully committed to product transparency and safety disclosure. All off-road only products are clearly identified on our website, on the product packaging, and on the tire sidewall itself. If you have any questions regarding the intended application of any product, we strongly encourage you to contact our team before completing your purchase.

By purchasing any product from TRAKFORCE OFF-ROAD TIRES, the buyer voluntarily and expressly waives any and all claims against TRAKFORCE OFF-ROAD TIRES, its owners, employees, agents, distributors, and affiliated parties. This waiver includes but is not limited to the following:

Assumption of Risk

• The buyer fully understands and acknowledges that off-road activities and the use of off-road tires carry inherent risks, including but not limited to: vehicle damage, personal injury, and property damage
• The buyer voluntarily assumes all risks associated with the purchase, installation, and use of TRAKFORCE products
• TRAKFORCE OFF-ROAD TIRES shall not be held liable for any injury, death, property damage, financial loss, or legal consequence arising from the use or misuse of its products

Limitation of Liability

• TRAKFORCE OFF-ROAD TIRES' total liability to any buyer shall not exceed the original purchase price of the specific product(s) in question
• TRAKFORCE OFF-ROAD TIRES is not liable for incidental, consequential, indirect, special, or punitive damages of any kind
• TRAKFORCE OFF-ROAD TIRES is not responsible for damages resulting from improper installation, overloading, misuse, negligence, accidents, or use outside the product's intended application
• TRAKFORCE OFF-ROAD TIRES is not liable for damage to the vehicle, rims, or other components resulting from the use of its products

Release of Claims

By completing a purchase, the buyer releases, discharges, and holds harmless TRAKFORCE OFF-ROAD TIRES from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained in connection with the purchase or use of TRAKFORCE products.

Intended Use

All TRAKFORCE tire products must be used strictly within their designated application category. Using a product outside its intended application immediately voids any product-related claims against TRAKFORCE OFF-ROAD TIRES and transfers full liability to the buyer.

Load & Speed Ratings

• Buyers must verify that the selected tire's load rating is appropriate for their vehicle's gross vehicle weight rating (GVWR)
• Exceeding the tire's load capacity is dangerous and is done entirely at the buyer's risk
• Off-road tires have specific speed limitations; exceeding these limits can cause tire failure and serious injury
• TRAKFORCE OFF-ROAD TIRES is not responsible for failures resulting from overloading or speed limit violations

Tire Pressure & Maintenance

• Buyers are responsible for maintaining proper tire pressure at all times as specified in the product guidelines
• Underinflation or overinflation can cause tire failure, vehicle instability, and accidents
• Regular inspection of tires for wear, damage, and proper seating is the sole responsibility of the buyer
• Tires showing signs of damage, unusual wear, or deformation must be immediately removed from service

Vehicle Compatibility

• The buyer is solely responsible for verifying that the selected tire size and specification is compatible with their vehicle
• Improper fitment can cause damage to the vehicle and represents a safety hazard
• TRAKFORCE OFF-ROAD TIRES provides compatibility information as a general guide only; it does not constitute a guarantee of fitment
• When in doubt, consult a qualified tire technician or contact our support team before purchasing

Age Requirement

All purchasers must be 18 years of age or older. By completing a purchase, you confirm that you meet this age requirement.

Professional Installation

TRAKFORCE OFF-ROAD TIRES strongly recommends that all tires be installed by a qualified and certified tire technician using professional equipment. Improper installation can result in serious injury, death, or property damage.

• Tires must be mounted on rims that meet the manufacturer's recommended width and diameter specifications
• All tires must be properly balanced after installation to prevent vibration and uneven wear
• Lug nuts must be torqued to the vehicle manufacturer's specifications
• Tires must be inflated to the recommended pressure using a calibrated pressure gauge
• After installation, tires must be inspected for proper bead seating before the vehicle is operated

Post-Installation Inspection

• Re-torque all lug nuts after the first 50–100 miles of use
• Check tire pressure after the first use and regularly thereafter
• Inspect tires for unusual wear patterns, cuts, bulges, or embedded objects regularly
• Tires showing any signs of structural damage must be removed from service immediately

Safety Warning

Tire mounting and demounting are dangerous procedures that should only be performed by trained professionals using proper equipment. Attempting to mount or demount tires without proper equipment can result in serious injury or death. TRAKFORCE OFF-ROAD TIRES assumes no liability for injuries or damages resulting from improper installation procedures.

Order Processing

• All orders placed through trakforce.us are subject to product availability and confirmation
• TRAKFORCE OFF-ROAD TIRES reserves the right to cancel any order at its sole discretion, including but not limited to cases of pricing errors, suspected fraud, or product unavailability
• Order confirmation emails do not constitute a binding contract until the order has been fulfilled and shipped
• TRAKFORCE OFF-ROAD TIRES is not responsible for orders placed with incorrect shipping addresses, sizes, or quantities provided by the buyer

Pricing

• All prices are listed in United States Dollars (USD) and are subject to change without prior notice
• Prices do not include applicable taxes, duties, or shipping fees unless explicitly stated
• TRAKFORCE OFF-ROAD TIRES is not responsible for additional import duties or taxes that may apply to international orders
• Promotional pricing is valid only for the specified promotional period and cannot be applied retroactively

Shipping & Delivery

• Most orders ship within 1–3 business days from the date of purchase confirmation
• Estimated delivery times are provided as a reference only and are not guaranteed
• TRAKFORCE OFF-ROAD TIRES is not liable for delays caused by shipping carriers, weather events, customs, or other circumstances outside its control
• Risk of loss and title for products pass to the buyer upon delivery to the shipping carrier
• Buyers must inspect all shipments upon receipt and report any damage or discrepancies within 48 hours of delivery

Payment

• Payment is due in full at the time of purchase unless a financing arrangement has been established through an approved third-party provider
• TRAKFORCE OFF-ROAD TIRES accepts all major credit cards and other payment methods displayed at checkout
• All transactions are processed through secure, PCI-compliant payment processors

Limited Warranty Coverage

TRAKFORCE OFF-ROAD TIRES offers a limited manufacturer's warranty on its products against defects in materials and workmanship under normal use conditions and within the product's intended application.

• Warranty coverage applies only to products used within their specified intended application (off-road use)
• Warranty claims must be submitted with proof of purchase from trakforce.us or an authorized dealer
• Defective products will be repaired or replaced at TRAKFORCE OFF-ROAD TIRES' sole discretion
• Warranty does not cover shipping costs associated with returning defective products unless the defect is confirmed by TRAKFORCE

Warranty Exclusions

This warranty does not cover damage resulting from:

• Misuse, abuse, negligence, or accidents
• Use outside the product's intended off-road application
• Improper installation, mounting, or balancing
• Overloading or exceeding the tire's rated speed or load capacity
• Improper inflation — both underinflation and overinflation
• Road hazards including cuts, punctures, impact damage, or bruising
• Alterations or modifications to the product after purchase
• Normal wear and tear
• Use on public roads or highways (non-DOT approved products)

Disclaimer of Implied Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAKFORCE OFF-ROAD TIRES DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Return Eligibility

• Returns are accepted within 30 days of delivery for unused products in their original condition and packaging
• Products must be unmounted, unused, and free of any signs of installation or use
• A return authorization must be obtained from TRAKFORCE OFF-ROAD TIRES before sending any product back
• Returns without prior authorization may be refused and returned to the sender at their expense

Non-Returnable Items

• Tires that have been mounted, installed, or used in any way
• Products that have been damaged, altered, or modified after delivery
• Special order or custom products
• Products returned beyond the 30-day window
• Products without original packaging or proof of purchase

Refund Process

• Once a returned product is received and inspected, TRAKFORCE OFF-ROAD TIRES will notify the buyer of the approval or rejection of the refund
• Approved refunds will be processed to the original payment method within 5–10 business days
• Shipping costs are non-refundable unless the return is due to a verified product defect or shipping error by TRAKFORCE
• Return shipping costs are the responsibility of the buyer unless otherwise stated

Defective Products

If a product arrives damaged or with a manufacturing defect, the buyer must notify TRAKFORCE OFF-ROAD TIRES within 48 hours of delivery with photographic evidence. In such cases, TRAKFORCE will cover return shipping costs and provide a replacement or full refund at its discretion.

TRAKFORCE OFF-ROAD TIRES offers financing options through third-party financial service providers, including American First Finance and Snap Finance. The following terms apply to all financing transactions:

Third-Party Financing

• Financing is provided exclusively by third-party lenders. TRAKFORCE OFF-ROAD TIRES is not a lender and does not make credit decisions
• Approval, terms, interest rates, and payment schedules are determined solely by the financing provider
• TRAKFORCE OFF-ROAD TIRES is not responsible for any terms, fees, or conditions imposed by the financing provider
• All financing agreements are between the buyer and the financing provider; TRAKFORCE OFF-ROAD TIRES is not a party to that agreement

Buyer Responsibility

• The buyer is responsible for reviewing, understanding, and complying with all terms of the financing agreement before signing
• Missed payments or default on a financing agreement may result in additional fees, collection actions, or negative credit reporting as determined by the financing provider
• Returning a product purchased through financing does not automatically cancel the financing agreement; the buyer must contact the financing provider directly

All content published on trakforce.us, including but not limited to text, images, graphics, logos, product names, videos, and design elements, is the exclusive intellectual property of TRAKFORCE OFF-ROAD TIRES or its licensed content providers.

• Each party shall bear its own legal fees and costs unless otherwise determined by the arbitrator

Severability
